How Should a Protection Order Be Drafted When Life Is Threatened?
If the perpetrator’s conduct has become so serious that the victim feels their life is in danger, the terms of the protection order must be written clearly and specifically when applying for it.
The law allows “prohibition of approach” clauses to be included in the court order, for example:
📌 The perpetrator must not come within 50 meters of the victim
📌 The perpetrator must not appear at the victim’s residence or workplace
📌 The perpetrator must not harass or threaten the victim
The 50-meter restriction is particularly important.
This is because many victims not only suffer physical injuries but also endure severe psychological trauma. Once the perpetrator approaches, the victim may experience intense anxiety, fear, or even panic reactions.
If the perpetrator violates the court order, the legal consequences may include:
📌 Ordinary breach of a court order
Maximum penalty: imprisonment of up to 6 months, or a fine of up to RM2000, or both.
📌 Breach of a court order involving violence
Maximum penalty: imprisonment of up to 1 year, or a fine of up to RM4000, or both.
