Divorce & Custody
Edward Ng & Partners is proud to be recognized for its excellence in legal services and commitment to delivering outstanding results for clients. Our firm has been nominated as the top Finalist at the ALB Malaysia Law Awards 2026 in the category of “Matrimonial and Family Law Firm of the Year“.
At Edward Ng & Partners, we recognise that family law matters—whether dealing with the end of a marriage or the arrangements for children—are among the most emotionally charged and legally intricate proceedings our clients may face. Whether you are considering separation, seeking a divorce, exploring judicial separation, or investigating the possibility of a nullity (annulment) of marriage, our team brings clarity, empathy and rigorous legal guidance.
Our Services
We provide a full spectrum of services in the divorce, separation, annulment and custody arena, including:
1. Divorce & Legal Separation
We assist clients with both agreed (joint petition) and contested (single petition) divorces under Malaysia’s civil law regime. We guide you through filing the petition, serving notices, obtaining the decree and evaluating the most appropriate path given your circumstances.
2. Judicial Separation
For clients who wish to live apart and cease marital obligations without dissolving the marriage, we advise and represent in petitions for a decree of judicial separation. We also explain clearly that judicial separation does not dissolve the marriage and parties remain legally married, with attendant legal consequences.
3. Nullity of Marriage (Annulment)
In cases where a marriage is void or voidable, our firm advises on and conducts proceedings for a decree of nullity (i.e., declaring that the marriage was never valid, or is to be treated as never valid). We explain the legal grounds and walk you through the High Court petition process.
4. Child Custody, Care & Control, Access and Guardianship
We advise and represent clients in matters involving children: determining who will have day-to-day care and control, who will act as guardian, and what access/visitation rights the other parent will have. The welfare of the child is always the paramount concern. We assist with interim arrangements during proceedings and final orders and in seeking variation of existing orders when circumstances change.
5. Spousal & Child Maintenance (Support Obligations)
We advise on rights and duties of both spouses and parents for financial maintenance: for children, for a spouse (where applicable), and for interim relief pending the outcome of proceedings. We analyse income, expenses, dependants’ needs and assist with contested or negotiated maintenance arrangements.
6. Division of Matrimonial Assets & Property Settlement
We advise on the division of matrimonial assets (such as property, business interests, investments, inheritance, pre-marital wealth) following divorce or judicial separation. We assist you in assessing contributions (financial and non-financial), future needs (including children’s), negotiating settlements, drafting consent orders and representing you in contested hearings.
7. Alternative Dispute Resolution & Negotiated Settlements
Recognising that litigation can be costly, protracted and emotionally taxing, we assist clients in mediation or negotiated settlement strategies. We help draft settlement agreements, consent orders, and advise on the relative benefits of ADR versus full court proceedings.
8. Cross-Border and Multi-Jurisdictional Considerations
For clients with overseas assets, spouses of foreign nationalities or international custody/maintenance issues, we advise on recognition of foreign divorce or nullity orders, registration of overseas decrees, and the interplay between Malaysian law and foreign jurisdictions to protect your interests globally.
9. Children’s Rights, Protection Orders & Ancillary Relief
We assist in sensitive related matters: protection orders in cases of domestic violence or child-welfare cases, guardianship applications, adoption issues (where applicable) and ancillary relief in the family court context.
