Key Legal Considerations in Malaysia
For non-Muslims, a valid Will must be in writing, signed by the testator and witnessed by at least two competent witnesses.
If an individual dies without a valid Will, their estate will be distributed according to statutory rules of intestate succession, which may not align with their personal wishes.
The process of obtaining a Grant of Probate (or Letters of Administration in the absence of a Will) is regulated by statute; the executor or administrator must comply with procedural requirements, file the necessary documents and discharge their duties within defined legal responsibilities.
