After Divorce, Can I Still Claim Maintenance
from My Ex Husband❓
1. Can maintenance continue after divorce if it was already paid during marriage?
If the husband had been consistently providing maintenance during the marriage (e.g. monthly transfers),
the wife may apply to the court to continue receiving such maintenance after divorce.
The key is not whether the parties are divorced, but whether:
📌 The payments were consistent
📌 They were used to sustain the existing lifestyle
📌 There are bank records or documentary proof
If continuity is established, the court will give serious consideration.
2. Must maintenance be paid monthly? Can it be paid as a lump sum?
A lump sum maintenance can be applied for, but it is not suitable in every case.
The court will consider:
📌 Age
📌 Earning capacity
📌 Financial ability of the other party
📌 Future needs
In some cases, the calculation may follow:
Expected working years × monthly maintenance × 12 months
However, approval depends entirely on the specific case.
3. Can a high-spending lifestyle be maintained after divorce?
If a high standard of living was maintained during the marriage (e.g. fine dining, frequent travel),
a similar level may be claimed—but:
The court distinguishes:
📌 Necessities
📌 Luxuries
You may claim a reasonable overall amount,
but the court will not micromanage specific expenditures.
4. Are inherited or gifted properties matrimonial assets?
General principle:
📌 Pure inheritance / gifts are not automatically matrimonial assets
However, if during marriage:
📌 Both parties lived in the property
📌 Contributed to maintenance, renovation, or expenses
📌 Used it as a family home
It may be treated as having been “matrimonialised”.
The key is contribution, not ownership label.
5. How are cars, drivers, and company shares treated?
Cars
📌 Necessary vehicle: possible entitlement
📌 Luxury/sports cars: generally not necessary
Driver
📌 If necessary, costs may be included (salary, EPF, SOCSO)
Company shares
📌 No direct involvement → usually not divided
📌 May be converted into monetary compensation
6. Can EPF be divided?
Yes, but limited to:
Accumulation during marriage (until separation/divorce)
Also:
📌 Not necessarily equal division
📌 Court considers overall fairness
7. Can one continue business-class travel post-divorce?
It can be requested, but:
Courts usually award a lump annual amount rather than approving individual trips.
8. Titles and legal status
Post-divorce:
Titles obtained through marriage generally cannot be retained.
Alternative:
Judicial Separation — marriage not dissolved, but legal arrangements addressed.
9. What if the other party refuses to comply?
Legal enforcement is available, including:
Contempt of court proceedings
Possible imprisonment in serious cases
Final Reminder
Divorce is not merely emotional—it involves law, evidence, strategy, and timing.
Evidence matters more than emotions.
Professional judgment matters more than impulse.
